Booking Terms and Conditions
Effective Date: January 1, 2024
These Booking Terms and Conditions (“Terms”) apply to cruise bookings made with Gulet Cruise Montenegro (“the Company,” “we,” “our,” or “us”), operated by Yacht Leisure doo, whose registered address is at Iva Vojnovica 25, 20000 Dubrovnik, Croatia and office located at Porto Montenegro Marina, Town Quay 2, 85320 Tivat, Montenegro. By making a booking, you agree to these Terms.
1. BOOKING YOUR HOLIDAY
(a) Making a Booking: To book your holiday, contact us directly at +44 20 80404914 or email reservations@guletcruisemontenegro.com. We will provide a price per person tailored to your requirements.
(b) Deposit: To secure your booking, a deposit of 20% is required. Payment can be made via bank transfer or credit card (MasterCard or Visa) to Dm Yachting doo. If we cannot confirm your booking, the deposit will be refunded in full.
(c) Information Required: At the time of booking, you must provide the names (as shown in passports), dates of birth, and nationalities of all party members.
(d) Special Requests:
Special requests, including dietary requirements and preferred cabin or bed configuration, must be communicated in writing at the time of booking.
We are able to accommodate certain dietary requirements, including vegetarian, vegan and gluten-free diets, to a reasonable extent. However, our vessels operate with one chef and a single galley preparing meals for all guests on board, and therefore we cannot provide fully separate menus, specialist meals, or guarantee the complete absence of allergens or cross-contamination. If dietary requirements, allergies or intolerances are not communicated to us in writing at the time of booking, we may not be able to provide suitable alternative meal options during the cruise.
Cabins are allocated according to availability. Guests requiring a specific bed configuration, such as a double bed or twin beds, must select or request the appropriate cabin type at the time of booking. Where no specific cabin or bed configuration has been booked or confirmed, cabins may be assigned at our discretion and we cannot guarantee that later requests for a different configuration can be accommodated.
While we will make reasonable efforts to accommodate other special requests, these cannot be guaranteed unless specifically confirmed by us in writing.
(e) Confirmation: A contract is formed when we issue a Confirmation Invoice upon receipt of the correct deposit.
(f) Verification of Details: Review your Confirmation Invoice upon receipt. Contact us immediately to address any discrepancies.
(g) Travel Agent Bookings: If you book through a travel agent, all communications will be directed to the agent, who will act as your representative.
(h) Final Payment: The balance of your holiday cost is due 60 days before departure. For reservations made within 60 days of departure, full payment is required at booking. Failure to make timely payments may result in cancellation and the application of cancellation charges as outlined below.
2. AMENDMENTS & CANCELLATION
(a) Amendments by You: Requests for amendments must be submitted in writing by the person who made the initial payment. While we will strive to accommodate changes, we cannot guarantee availability. Additional costs may apply. Date amendments are permitted within six months of the original departure date; after six months, standard cancellation charges apply.
Transfers of Booking: You may transfer a booking to another person subject to the following:
The new traveler meets all booking conditions.
Notification is provided at least seven days before departure.
Outstanding balances and transfer-related costs are paid.
The transferee agrees to these Terms.
Both the original booker and transferee are jointly and severally liable for payments. If no replacement is found, cancellation charges will apply.
(b) Cancellation by You: Cancellations must be made in writing by the person who made the initial payment. Cancellation charges are as follows:
60+ days before departure: Loss of deposit
59-30 days before departure: 50% of total holiday cost
29-0 days before departure: 100% of total holiday cost
Cancellation charges will be deducted from payments already made. We recommend securing comprehensive travel insurance as per clause 6.
3. PRICING
All prices are quoted in euros (EUR) and include applicable taxes. We reserve the right to adjust pricing due to fluctuations in costs beyond our control, such as fuel surcharges, taxes, and exchange rates. Price changes will not affect confirmed bookings unless arising from changes in government-mandated fees.
4. CHANGES BY THE COMPANY
While we strive to deliver all services as described, unforeseen circumstances may require changes. In such cases:
Minor Changes: Changes such as itinerary adjustments for safety reasons or vessel changes to one of the same category are considered minor. No reimbursement will be provided for these changes.
Significant Changes: If we need to replace your vessel with one of a lower category, you will have the option to:
Accept the change and receive a refund of the difference in price.
Decline the change and receive a full refund.
We are not liable for changes due to force majeure, such as natural disasters or political instability.
5. LIABILITY
The Company’s liability is limited in accordance with applicable Montenegrin laws. We are not responsible for:
Losses or delays caused by third parties or external events.
Illness, injury, or loss during your holiday unless due to negligence on our part.
6. TRAVEL INSURANCE
Adequate travel insurance is mandatory for all guests. Your insurance must cover cancellation, medical expenses, personal injury, and loss of belongings.
7. RULES ON BOARD, OPERATIONAL PROCEDURES AND GUEST CONDUCT
(a) General Conduct and Respectful Behaviour
Guests are expected at all times to behave in a respectful, reasonable and considerate manner towards other guests, the crew, the Captain, Company representatives, managers, agents, suppliers and any other persons involved in the operation of the cruise.
Guests must not engage in abusive, threatening, aggressive, discriminatory, insulting, intimidating or persistently disruptive behaviour. Guests are also expected to respect the shared nature of the onboard experience and must not repeatedly interfere with, disrupt or negatively affect the comfort, enjoyment or general atmosphere of the cruise for other passengers, crew members or Company representatives.
The Company recognises that guests may raise legitimate concerns or complaints. Raising a reasonable complaint will not in itself be regarded as disruptive behaviour. However, persistent unreasonable conduct, harassment, aggression, refusal to cooperate with the crew or Company representatives, or behaviour that materially affects the safe and peaceful operation of the cruise or the experience of other guests may be considered a breach of these Terms.
Where reasonably necessary, the Captain and/or the Company may issue a warning and require the guest to modify their behaviour. In cases of serious misconduct, repeated misconduct, threats to safety, harassment, aggression, deliberate damage, refusal to follow lawful or reasonable instructions, or behaviour which substantially disrupts the cruise, the Company reserves the right to disembark the guest at the nearest safe and reasonably practicable location.
A guest removed from the vessel for such reasons will not be entitled to a refund or compensation for the unused portion of the cruise, and any additional transport, accommodation, repatriation or other expenses arising from the disembarkation will be the guest’s responsibility.
(b) Captain’s Authority and Safety Instructions
The Captain has overall and final authority on board in relation to the safe navigation, operation and management of the vessel.
All guests must comply promptly with safety instructions and any reasonable directions given by the Captain and crew. This includes instructions concerning movement around the vessel, swimming, water activities, tenders, boarding and disembarkation, navigation, anchoring and any other matters relating to safety or vessel operations.
The Captain may restrict or prohibit access to particular areas of the vessel or participation in particular activities whenever considered necessary for safety, weather, sea conditions, operational reasons or applicable maritime regulations.
Failure to comply with safety instructions or repeated refusal to follow reasonable instructions may result in restriction from certain activities or, where sufficiently serious, disembarkation from the vessel without refund.
(c) Itinerary and Captain’s Right to Modify the Route
All published or proposed itineraries are indicative and are subject to change.
The Captain has final authority over the vessel’s route, navigation, anchorage locations, ports of call, departure and arrival times, use of sails and/or engines, and all other navigational decisions.
The itinerary may be modified, shortened, extended, rearranged or substituted where reasonably necessary due to circumstances including, but not limited to:
The safety of passengers, crew and vessel will always take priority over the published itinerary or any guest preference.
Use of Sails: Guests acknowledge that although our vessels are sailing vessels or motor-sailors, navigation under sail is not guaranteed on any particular day, passage or cruise. The decision whether to raise, reduce or lower the sails, or to navigate partly or entirely under engine power, remains solely at the Captain’s discretion.
The Captain will take into account wind strength and direction, sea conditions, weather forecasts, navigational safety, distance to the next destination, scheduled arrival times, marina or port requirements, the overall cruise programme and any other relevant operational considerations.
Sails may therefore not be used where, for example, wind conditions are too strong for safe or comfortable sailing, where there is insufficient or unsuitable wind to reach the planned destination within a reasonable or scheduled time, where the required course is not suitable for sailing, or where operational or navigational circumstances make the use of engine power more appropriate.
The use of engine power instead of sails, or the use of sails for only part of a passage, does not constitute a reduction in the cruise service or entitle guests to a refund, compensation or other remedy, provided that the cruise continues to be operated in accordance with these Terms.
Where an intended destination, anchorage, port, excursion or route cannot reasonably be used, the Captain and Company may provide an alternative route, port, anchorage or activity where practicable. Such operational changes do not constitute a failure to provide the cruise where the overall cruise service continues to be delivered.
Guests may not require the Captain to navigate to, remain at, or depart from a particular location, use a particular route, or operate the vessel under sail where the Captain considers doing so unsafe, unlawful, impracticable, incompatible with the scheduled programme, or inconsistent with applicable navigation rules or instructions from maritime authorities.
Guests also acknowledge that sailing conditions are naturally variable and cannot be guaranteed in advance. The absence of suitable wind, the presence of excessive wind, or other weather and sea conditions affecting the use of sails are outside the Company’s control.
(d) Shared Cruises – Itinerary, Meals and Activities
Guests booking a shared cruise acknowledge that they are participating in a pre-arranged group programme with other passengers.
The itinerary, cruising programme, meal arrangements, meal times, included excursions, local tours, activities, embarkation and departure schedules are organised by the Company, Captain and crew for the group as a whole.
Individual guests on a shared cruise may not require changes to the itinerary, navigation schedule, ports of call, meal schedule, menu, meal times, included tours or activities according to their personal preference.
Where operationally possible, the crew may consider reasonable individual requests, but any such accommodation is entirely subject to the needs of the group, vessel operations, safety, available resources and the scheduled programme and cannot be guaranteed.
The Captain and Company may also adjust scheduled meal times, activities, tours or daily arrangements where reasonably necessary because of sailing conditions, arrival times, port formalities, excursions, weather, operational requirements or other circumstances.
Guests who choose not to participate in a scheduled meal, excursion, activity or part of the itinerary are not entitled to a refund or replacement service unless expressly agreed otherwise by the Company.
(e) Private Charters – Guest Preferences and Programme Flexibility
Guests booking the vessel on a private charter basis have greater flexibility to personalise their cruise programme.
Subject to the terms of their booking and any applicable additional charges, private charter guests may request changes to matters including:
Such requests remain subject to advance notice where required, availability of provisions, crew working requirements, vessel capabilities, local suppliers, applicable costs, weather, sea conditions, port and marina availability, navigation regulations and all applicable legal and operational restrictions.
Any additional meals, provisions, excursions, transfers, guides, activities or other services which are not included in the original charter price may result in additional charges.
Regardless of guest preferences or the proposed charter itinerary, the Captain retains final authority over the route, sailing programme, anchorages, navigation and operation of the vessel. No guest request may override the Captain’s decision where safety, weather, maritime regulations, vessel operations or other navigational considerations are concerned.
(f) Embarkation and Disembarkation
Unless otherwise specifically confirmed by the Company in writing:
Guests should arrange flights, transfers, accommodation and other travel plans accordingly.
Access to the vessel before the scheduled embarkation time cannot be guaranteed because the crew requires sufficient time for cleaning, provisioning, technical preparation, maintenance and other operational procedures between cruises.
Similarly, guests cannot remain on board after the scheduled disembarkation time unless expressly authorised by the Company or Captain.
The Company is not responsible for costs arising from travel arrangements made by guests which conflict with the stated embarkation or disembarkation schedule.
(g) Early Arrival and Luggage Storage
Where guests arrive before the scheduled embarkation time or wish to leave luggage temporarily after disembarkation, the Company may, upon advance request, assist with luggage storage where operationally possible.
Luggage storage is not included as a guaranteed service and remains subject to vessel location, crew availability, turnaround operations, cleaning schedules, marina access, security and other operational considerations.
Guests should therefore contact the Company in advance and should not assume that luggage can be accepted or stored before embarkation or after disembarkation.
Any luggage accepted before embarkation or temporarily stored after disembarkation remains subject to the provisions of these Terms concerning personal belongings.
(h) Luggage Restrictions
Due to limited storage space on board sailing vessels, guests are required to travel with soft-sided luggage, duffel bags or other collapsible bags wherever reasonably possible.
Large rigid or hard-shell suitcases are unsuitable for storage in many cabins and onboard compartments and may obstruct guest or crew areas.
The Company reserves the right to refuse excessively large, rigid, heavy or unsuitable luggage where it cannot be safely or reasonably stored on board.
Guests are responsible for ensuring that their luggage is suitable for the vessel and should contact the Company before travel if they are uncertain whether a particular item can be accommodated.
(i) Smoking Policy
Smoking is strictly prohibited inside cabins, saloons, bathrooms and all other enclosed areas of the vessel.
Smoking may only take place in designated outdoor areas and only where authorised by the Captain or crew.
Guests must take particular care with cigarettes and other smoking materials because of the fire risk associated with vessels.
(j) Alcohol Consumption
Responsible alcohol consumption is expected at all times.
The Captain and crew reserve the right to refuse or limit the service or consumption of alcohol where, in their reasonable judgement, a guest’s level of intoxication may create a safety risk, cause disruption, lead to inappropriate behaviour or interfere with the safe operation of the vessel.
Intoxication does not excuse a guest from compliance with these Terms, safety instructions or standards of behaviour.
(k) Personal Belongings
Guests remain responsible for their money, documents, electronic devices, jewellery, luggage and other personal belongings.
The Company cannot accept responsibility for loss, theft or damage to personal belongings except to the extent that such liability cannot legally be excluded or where the loss or damage results directly from the Company’s proven negligence.
Guests are encouraged to keep valuables secure and to maintain appropriate travel insurance covering their personal possessions.
(l) Damage to the Vessel or Property
Guests must take reasonable care of the vessel, its furnishings, equipment, water toys, tenders, fixtures and other property belonging to the Company, vessel owner, crew or third-party suppliers.
Guests may be held responsible for the reasonable cost of repairing or replacing property which they intentionally damage or damage through negligence, misuse or failure to follow crew instructions.
Where damage is caused by a particular guest, the Company may seek reimbursement directly from that guest.
(m) Environmental Responsibility
Guests are required to respect the marine environment and comply with instructions from the Captain and crew concerning waste disposal, water usage, sewage systems, protected areas, swimming areas and environmental regulations.
Nothing may be thrown into the sea unless expressly permitted by the crew.
Guests must comply with any special rules applicable to marine parks, national parks, protected bays, anchorages or other environmentally sensitive locations visited during the cruise.
(n) Prohibited Items and Illegal Conduct
The following are strictly prohibited on board:
Guests must comply with the laws and regulations of every country, port and jurisdiction visited during the cruise.
Possession of prohibited items, serious illegal conduct or behaviour which exposes the vessel, Company, crew or other passengers to legal or safety risks may result in immediate disembarkation without refund and may be reported to the appropriate authorities.
(o) Right to Refuse Continued Carriage or Disembark a Guest
The Company and/or Captain reserve the right to refuse continued carriage and require a guest to leave the vessel where the guest:
Where reasonably practicable, disembarkation will take place at a safe port or other appropriate location.
A guest disembarked as a consequence of their own serious or repeated misconduct will not be entitled to reimbursement for unused services, and the Company will not be responsible for additional accommodation, transport, flights, transfers, repatriation or other expenses resulting from the disembarkation.
8. COMPLAINTS
If you experience any issues during your holiday, report them immediately to the vessel’s crew or our team. If unresolved, submit a written complaint within 7 days of your return.
9. GOVERNING LAW AND JURISDICTION
These Terms are governed by Montenegrin law. Any disputes will be resolved in the courts of Montenegro.
